£4,000 confiscated from convicted drug dealer

At Kirkcudbright Sheriff Court yesterday, a Confiscation Order for £4,000 was made against Andrew Robert Hunter under the Proceeds of Crime Act 2002 (POCA).

On 14 October 2010 Hunter, from Stranraer, was sentenced to 300 hours Community Service for being concerned in the supply of drugs.

The court ruled that, by virtue of his conviction for drug offences he had a criminal lifestyle. This meant that the court was entitled to consider that income and assets he obtained during the six years prior to the date of the offence were the proceeds of crime, and to take these into account when determining the amount of the confiscation order.

Following the hearing, Lindsey Miller, Crown Office and Procurator Fiscal Service POCA Champion and Head of the Serious and Organised Crime Division, said:

“Drugs pollute our society and today, convicted drug dealer Robert Hunter has been stripped of the assets he amassed through his criminality.

“The people of Scotland can be assured that not only will we prosecute offenders to the full extent of the law but we will also ensure that those offenders do not benefit from their criminal lifestyle.”
